Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Wonderbrain Enterprises (ABN to be issued), an Australian business based in Queensland ("WonderBrain", "we", "us"), governing your access to and use of the WonderBrain website, applications, and services (the "Service"). By creating an account or using the Service you agree to these Terms.

1. The Service

WonderBrain helps parents and allied health practitioners generate printable visual resources for neurodivergent children using artificial intelligence. The Service produces educational materials (the "Outputs") based on the templates you choose and the customisations you provide.

2. Not medical, clinical or legal advice

Outputs are educational aids only. They do not constitute medical, psychological, therapeutic, legal, or diagnostic advice. They are not a substitute for the professional judgement of a qualified clinician. You are responsible for evaluating whether any Output is appropriate for the child or client it is intended for.

3. Eligibility & accounts

  • You must be at least 18 years old to create an account.
  • You are responsible for the accuracy of information you provide and for keeping your credentials secure.
  • Practitioner accounts may only be used by qualified individuals or appropriately credentialed teams.
  • If you create profiles for children, you confirm you have the legal authority to do so as a parent, guardian, or treating practitioner with informed consent.

4. Acceptable use

You agree not to:

  • Submit personal information about identifiable adults, addresses, phone numbers, URLs, or financial data in customisations.
  • Generate sexual, violent, hateful, harassing, or otherwise harmful content.
  • Attempt to reverse-engineer the Service, bypass quotas, scrape templates or Outputs, or interfere with other users.
  • Use the Service in a way that breaches Australian law or any applicable law in the country you access it from.

We may suspend or terminate accounts that breach this section.

5. AI-generated content

Outputs are produced by third-party AI models. They may contain inaccuracies, repeated elements, spelling errors, or other artefacts. You are responsible for reviewing every Output before sharing it with a child or client. To the extent permitted by law, you own the Outputs you generate, subject to your continued compliance with these Terms; we retain ownership of the Service, templates, prompts, and underlying technology.

6. Subscriptions, billing and refunds

  • Paid plans renew automatically until cancelled. You can cancel any time via the billing portal; access continues until the end of the current period.
  • Prices are in Australian dollars and may include or exclude GST as displayed at checkout.
  • To the extent permitted by Australian Consumer Law, fees are non-refundable. Where statutory consumer guarantees apply, you remain entitled to refunds, repairs or remedies under that law.
  • Generation quotas reset on the first day of each billing period and do not roll over.

7. Sub-processors

We rely on Lovable Cloud (Supabase) for hosting and storage, Kie.ai for AI image generation, and Stripe for payment processing. By using the Service you consent to the transfer of your information to these providers. See our Privacy Policy for details.

8. Termination

You may close your account at any time from settings. We may suspend or terminate accounts for breach, suspected fraud, or extended inactivity. On termination we delete your account in line with our Privacy Policy.

9. Disclaimers & liability

The Service is provided "as is" without warranties of any kind to the maximum extent permitted by law. Nothing in these Terms excludes or limits any guarantee, warranty, right or remedy that applicable law (including the Australian Consumer Law) provides and that cannot be lawfully excluded. To the extent permitted by law, our aggregate liability for any claim arising out of the Service is limited to the fees you paid us in the 12 months preceding the claim.

10. Changes

We may update these Terms. Material changes will be notified by email or in-app at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Queensland, Australia. The courts of Queensland have exclusive jurisdiction over any disputes, subject to any non-excludable rights you have under consumer law in your country of residence.
